"Property Owner" means individuals or entities who list properties on our Platform.
"Real Estate Professional" means licensed real estate agents, brokers, or agencies using our Platform.
"Visitor" means individuals seeking to view, rent, or purchase properties through our Platform.
"Content" means all information, data, text, images, videos, and other materials available on our Platform.
2. Acceptance of Terms
By creating an account, accessing our Platform, or using our services, you confirm that:
- You are at least 18 years old
- You have the legal capacity to enter into these Terms
- You will comply with all applicable laws and regulations

Kasa provides a digital platform that enables:

- Shortlet booking services
- AI-powered property descriptions and search
- Mortgage calculation and bank integration
- Legal document generation assistance
3.2 Service Availability
We strive to maintain Platform availability but do not guarantee uninterrupted access. We may suspend or modify services for maintenance, updates, or improvements without prior notice.
4. User Accounts and Registration
4.1 Account Creation
To access certain features, you must create an account by providing accurate, complete information. You are responsible for maintaining account confidentiality, all activities under your account, notifying us of unauthorized access, and keeping your contact information current.

5. Property Listings and Content
5.1 Listing Requirements
Property listings must contain accurate information, include clear and recent photographs, specify all fees and charges upfront, comply with applicable housing and advertising laws, and not contain misleading or fraudulent information.
5.2 Content Standards
All content uploaded to our Platform must be legally owned or properly licensed by you, not infringe on third-party rights, not contain offensive, discriminatory, or illegal material, and comply with local advertising and fair housing laws.
5.3 Content Moderation
We reserve the right to review, modify, or remove content, suspend or terminate accounts for policy violations, and use automated systems to detect inappropriate content.
6. Prohibited Uses
You may not use our Platform to:
- Post false, misleading, or fraudulent property listings
- Engage in discriminatory practices based on protected characteristics
- Violate any applicable laws or regulations
- Interfere with Platform security or functionality
- Harvest user data or contact information
- Create multiple accounts to circumvent restrictions
- Post properties you do not own or have authority to list
7. Fees and Payment Terms
7.1 Subscription Fees
- Subscription fees are charged monthly or annually as selected
- All fees are exclusive of applicable taxes
- Fees are non-refundable except as required by law
- We may change subscription prices with 30 days' notice
7.2 Transaction Fees
- We charge a commission of 3-15% on shortlet bookings processed through our Platform
- Commission rates may vary based on booking value and duration

7.3 Payment Processing
- Payments are processed through secure third-party providers
- You authorize us to charge your selected payment method
- Failed payments may result in service suspension
8. Booking and Transaction Terms
All bookings are subject to property owner approval. Booking confirmations are sent via email and in-app notifications. Cancellation policies are set by individual property owners. We may facilitate payments between parties, property owners are responsible for tax obligations, and dispute resolution follows our established procedures.
9. AI and Technology Services
AI-generated property descriptions are suggestions only. Users remain responsible for accuracy of published content, and AI recommendations should be reviewed before use. Virtual tours are provided as-is, we do not guarantee virtual tour accuracy, and physical property inspections are recommended before transactions.
10. Privacy and Data Protection
Your privacy is important to us. Our Privacy Policy, incorporated by reference, explains how we collect, use, and protect your information. By using our Platform, you consent to our data practices as described in our Privacy Policy.
11. Intellectual Property Rights
The Platform, including its design, functionality, and underlying technology, is owned by Kasa and protected by intellectual property laws. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content for Platform operations. "Kasa" and related marks are our trademarks. Unauthorized use is prohibited.
12. Third-Party Services
Our Platform integrates with third-party services including mortgage lenders, financial institutions, payment processors, mapping and geolocation services, and AI and machine learning providers. We are not responsible for third-party service availability, accuracy, or performance.
13. Disclaimers and Limitations
Our Platform is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not verify all property information, users should conduct independent due diligence, and property conditions may change between listing and viewing. To the maximum extent permitted by law, our liability for damages arising from Platform use is limited to the fees paid by you in the 12 months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless Kasa, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform, violation of these Terms, property listings or content, or interactions with other users.
15. Termination
You may terminate your account at any time by contacting customer support. Paid subscriptions continue until the end of the billing period. We may terminate or suspend your account immediately for violation of these Terms, fraudulent or illegal activity, non-payment of fees, or extended account inactivity. Upon termination, your access ceases, content may be removed, outstanding fees remain due, and certain provisions survive termination.
16. Dispute Resolution
Parties agree to first attempt resolution through good faith negotiations. If negotiation fails, disputes will be submitted to mediation before an agreed mediator. Unresolved disputes will be settled through binding arbitration under Nigerian Arbitration and Conciliation Act. You waive the right to participate in class action lawsuits against us.
17. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any legal proceedings will be conducted in Lagos State, Nigeria.
18. Force Majeure
We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including natural disasters, government actions, or technical failures.
19. General Provisions
These Terms constitute the entire agreement between parties regarding Platform use. We may modify these Terms at any time, with material changes communicated via email or Platform notice 30 days before taking effect. If any provision is invalid, the remaining provisions remain in full force. We may assign these Terms without your consent, and our failure to enforce any provision does not constitute a waiver of our rights.
